§ 38-144. Industrial cost recovery system

  • (a) Persons discharging industrial wastes which are of greater strength and volume than normal, untreated domestic wastewater shall pay the city a charge to amortize 75 percent of the actual cost of the transportation and treatment facilities (grant amount) allocable to the treatment of wastes from such person.

    (b) Each year during the industrial cost recovery period, each industrial user of the treatment works shall pay its share of the 75 percent of the actual cost of the transportation and treatment facilities (grant amount) divided by the recovery period.

    (c) The industrial cost recovery period shall be equal to 30 years or the useful life of the transportation and treatment works, whichever is less.

    (d) Payment shall be made by industrial users no less often than annually. The first payment by an industrial user shall be made not later than one year after such user begins use of the transportation and treatment facilities.

    (e) An industrial user's share shall be determined as follows:

    Ct = 75 percent cost of treatment facility
    C1 = 75 percent cost of transportation facility
    A = Base annual charge for connection
    Vu = Volume contribution of user/day (MGD)
    Vt = Total volume contribution of all users/day (MGD)

    Cn = COD contribution for normal domestic wastewater

     

    (f) If there is a substantial change in the strength, volume or delivery flow rate characteristics introduced into the treatment works by an industrial user, such user's share shall be adjusted accordingly.

    (g) If there is an expansion or upgrading of the treatment works, each existing industrial user's share shall be adjusted accordingly.

    (h) An industrial user's share shall not include any portion of the amount allocable to unused or unreserved capacity.

    (i) An industrial user's share shall include any firm commitment to the city of increased use by such user.

    (j) An industrial user's share shall not include an interest component.
